Which of the following statements about movie ticket sales today are accurate?

These terms and conditions are applicable to the booking of movie tickets and food and beverages (either booked separately or along with the movie tickets) ("F&B") through www.amazon.in ("Amazon Site"). By availing the movie tickets and F&B, you hereby agree that Amazon is an intermediary within the meaning of the Information Technology Act, 2000 and the rules thereunder and merely facilitates the booking of movie tickets and F&B by customers on the Amazon Site, which is provided by and made available through the merchant, i.e., Bigtree Entertainment Private Limited, a company incorporated under the laws of India, with its registered office at Gr. Floor, Wajeda House, Gulmohar Cross 7. Juhu Scheme, Mumbai 400049 (hereinafter referred to as "BookMyShow" or "Bigtree" or "merchant").

You further agree that, (i) Amazon does not at any point of time during any transaction between you and the merchant, take the ownership of any of the services provided by merchant, including the provision of the movie tickets and / or F&B,; and (ii) Amazon does not at any point assert any rights or claims over the services facilitated by the merchant to the customer.

By availing movie tickets and F&B through the Amazon Site, you explicitly agree and acknowledge that:

  1. Bookings for the movie tickets and F&B once made by you cannot be cancelled, exchanged or refunded, except in accordance with the cancellation policy of the cinemas available to you for viewing at the 'order details' page to which you navigate from under the 'Your Orders' section and also from the booking confirmation e-mail which contains a link to the 'order details' page.
  2. Your booking confirmation for the movie tickets and the F&B (if any), will be sent via an e mail and/or SMS.
  3. You or the person collecting the movie ticket(s) on your behalf at the box office, will be required to print and present the e-ticket at the cinema / movie theatre box office counter at the premises of the cinema hall concerned, in order to avail a physical ticket. You will not be provided any separate voucher or coupon for any F&B booked by you, and the details of the F&B (if any) booked by you will be included in the copy of the movie ticket(s) provided to you at the box office. In the event you receive an m-ticket, the details of the F&B (if any) booked by you will form part of the m-ticket.
  4. To collect the movie tickets from the cinema box office counter, it is mandatory for you or any person collecting the movie ticket(s) on your behalf to present the debit/credit card that has been used to book ticket(s) along with the booking confirmation SMS or an e-mail print out, where specifically required by the cinema and conveyed to you through the booking confirmation SMS and / or e-mail.
  5. The holder of a physical movie ticket shall be deemed to be the owner of the movie ticket(s).
  6. A convenience fee per movie ticket(s) is levied on all tickets booked by you at the time of making the booking online. Kindly check once before you make the booking.
  7. Your booking of the movie ticket(s) and the F&B (if any) will also be subject to and governed by the merchant's terms and conditions, provided below.
  8. If the cinema cancels the show, Amazon will not be held responsible for such cancellation. In such cases, depending upon the terms and conditions for show cancellation of the relevant cinema, Amazon will automatically issue a refund to your original source of payment, for the movie ticket(s) and the F&B booked (if any) with applicable deductions, if any, in accordance with the cancellation policy of the cinema, within 48 hours of the cinema confirming the cancellation.
  9. If (i) you do not receive a booking confirmation ID (in the form of a confirmation SMS, e-mail) after submitting payment information, or; (ii) if you receive an error message or encounter a service interruption after submitting payment information, you should check your 'Your Orders' tab on your account on the Amazon Site for the order status of your booking. The details of the booking and the confirmation thereof should reflect in the 'Your Orders' tab within 30 minutes of making such booking. In case you still do not receive a booking confirmation, immediately report this to Amazon customer care. Amazon will not be responsible for any losses that may occur to you in the process.
  10. Please add to your address book associated with your e-mail id to ensure successful e-mail delivery in your inbox of all the e-mails concerning the movie-tickets and F&B, including the booking thereof. Amazon will not be responsible for any loss caused due to the confirmation e-mail or any other e-mail relating to the booking details and process not being delivered to your primary inbox of the e-mail address provided by you to Amazon.
  11. By booking movie ticket(s) and F&B on Amazon Site, you agree and undertake to adhere to and comply with the terms and conditions of the merchant provided below, in respect of all the bookings made by you for the movie tickets and F&B through Amazon Site.
  12. As per the movie theatre / cinema's terms and conditions, outside food and beverages are not allowed inside the movie theatre / cinema hall's premises.
  13. By availing the movie tickets and F&B (if any) through the Amazon Site, you accept and agree to all the applicable terms and conditions, including the specific terms and conditions in this section. You further accept that Amazon may send the alerts to the mobile phone number/e mail provided by you while registering on Amazon or to any such number updated on the Amazon Site subsequently or to any other phone number / e-mail address provided at the time of booking the movie ticket(s) and F&B (if any) on the Amazon Site.
  14. Notwithstanding anything to the contrary contained herein, neither Amazon nor affiliates of Amazon or its officers, directors, employees shall have any liability to you or to any third party for any direct, indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or relating to these terms and conditions, your booking of the movie ticket(s) and F&B (if any) and / or your use of the Amazon Site, even if any party had been advised of, knew of, or should have known of, the possibility of such damages or loss. To the extent permitted by law, Amazon's maximum aggregate liability to you for any causes whatsoever, and regardless of the form of action (whether liability arises due to negligence or any other tort, breach of contract, violation of statute, misrepresentation or for any other reason), will at all times be limited to the value of the movie ticket and the F&B (if any) purchased by you. To the extent permitted by law, you waive, release, discharge and hold harmless Amazon or affiliates of Amazon, and each of their directors, officers, employees, and agents, from any and all claims, losses, damages, liabilities, expenses and causes of action arising out of your use of the Amazon Site to undertake the bookings for the movie ticket(s) and F&B (if any).
  15. Partial cancellation of an order of movie ticket(s) and F&B (if any) is not allowed. To clarify, you will be allowed to cancel your entire order, i.e. all the tickets booked in one order / transaction along with any F&B booked and associated to such movie ticket(s); and part cancellation (eg- cancellation of 2 tickets out of 4 tickets booked, or cancellation of only F&B from the order) will not be permitted.
  16. Your order, i.e. the movie ticket(s) and the F&B booked along with the tickets (if any) can be cancelled in accordance with the cancellation policy so specified for those movie tickets.
  17. In case you cancel your order within the cancellation period so specified in the cancellation policy, you will receive a refund on ticket price and the F&B value (if any), in accordance with the terms of and applicability of the specified cancellation policy, in your original mode of payment within 3-5 working days of cancelling the ticket.
  18. Refund will only be provided for the movie ticket amount and F&B amount (if applicable), and any additional amount paid for convenience fees will not be refunded. For further details on cancellations and refunds, please review the cancellation policy of the cinemas available to you for viewing at the 'order details' page to which you navigate from under the 'Your Orders' section and also from the booking confirmation e-mail which contains a link to the 'order details' page.
  19. All seat layouts are representative in nature and the distance between rows and from screen can differ from the actual..

  21. These terms and conditions are to be read in conjunction with the BookMyShow terms of service set out below and the terms and conditions specified by the respective cinemas. However, in the event of any conflict between these terms and conditions and the terms and conditions of the merchant below, these terms and conditions will prevail, only to the extent of such conflict.

BOOKMYSHOW TERMS OF SERVICE

  1. Acceptance of Terms

    1.1. Booking of movie tickets and food & beverage coupons ("Services") on the Amazon.in website and the corresponding mobile application ("Amazon Platform") is powered by Bigtree. The Amazon Platform, to the extent it relates to providing the Services, shall hereinafter be referred to as the "Ticketing Platform".

    1.2. This User Agreement ("Agreement") sets out the terms and conditions on which Bigtree shall provide the Services to you (the "User") through the Ticketing Platform. In addition to this Agreement and depending on the Services opted for by the User, the User shall be required to read and accept the relevant terms of service ("TOS") for such Service, which may be updated or modified by Bigtree from time to time. Such TOS shall be deemed to be a part of this Agreement and in the event of a conflict between such TOS and this Agreement, the terms of this Agreement shall prevail.

    1.3. Use of the Ticketing Platform is offered to the User conditioned on acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be posted on the Ticketing Platform from time to time. For the removal of doubts, it is clarified that use of the Ticketing Platform by the User constitutes an acknowledgement and acceptance by the User of this Agreement and the TOS. If the User does not agree with any part of such terms, conditions and notices, the User must not use the Ticketing Platform.

    1.4. Additionally, the Amazon Platform may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, movie tickets, gift vouchers, combos, etc.). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the Amazon Platform. In the event that any of the terms, conditions and notices contained in this Agreement or the TOS conflict with the additional/other terms and guidelines specified by the Amazon Platform, then the decision on which of the aforesaid terms/guidelines shall apply will be mutually decided between Amazon and Bigtree, which shall be binding on the User.

  2. Modification of Terms

    Bigtree and Amazon reserve the right to change the terms, conditions and notices under which the Services are offered through the Ticketing Platform. The User shall be responsible for regularly reviewing these terms and conditions.

  3. Terms and Conditions Applicable to Use of Services

    3.1. Pricing and Availability

    Bigtree facilitates booking of Services on the Ticketing Platform on behalf of cinemas and does not control the inventory or its availability and pricing.

    3.2. Age Limit

    Children aged 3 years and above will require a separate ticket unless otherwise specified by any particular cinema, in accordance with its terms and conditions.

    3.3. Convenience Fee

    Convenience Fee charged on your transactions for the movie tickets booked on our website / application is levied by Bigtree Entertainment Private Limited / BookMyShow. The said fee is for providing you with a wide range of choices to book movie tickets with convenient modes of payment in advance for the shows desired to be attended by you and thus avoiding you the hassles of travelling to the cinema/venue in advance to book the desired seats for the shows, which prevents disappointment in having to settle for seats which are not preferred.

    3.4. Number of Tickets Per Customer or "Ticket Limits"

    When purchasing tickets on the Ticketing Platform you are limited to a specified number of tickets for each movie show.

    3.5. Censor warning

    Please check the censor warning before buying the tickets. Children below the age of 18 will not be allowed entry for an {A} rated movie. Also please check for any additional ratings/entry restrictions that may be applicable for events/movies from time to time.

    3.6. Order Confirmation

    If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm the same from your booking history on the 'Your orders' tab in your Amazon account, or with the customer service department of Amazon. Please refer to the Amazon terms of service above for further details.

    3.7. Refunds and Exchanges

    Please refer to the paragraph on refunds and exchanges on the Amazon terms and conditions above. Before purchasing tickets, carefully review your booking details. Bigtree and/or the Ticketing Platform will be unable to process exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged or destroyed tickets .

    3.8. Payment Verification

    In cases where a credit/debit card has been used to purchase the tickets, such credit / debit card will have to be produced for picking up the tickets at the venue. In case the credit/debit card user is not picking up the tickets, an authorization with the photocopy of this credit/debit card signed by the credit/debit card holder need to be produced at the time of picking up the tickets. Please note that signature on the card must match the signature used for authorization.

    3.9. Pricing and Other Errors

    If the amount you pay for a ticket is incorrect regardless of whether because of an error in a price posted on the Ticketing Platform or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date or you are able to order a ticket that was not supposed to have been released for sale, then: Bigtree will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of the Ticketing Platform.

    3.10. Cancelled/Postponed Events

    Occasionally, movies are canceled or postponed by the cinema. Should this occur, please follow the procedure set out in the Amazon terms and conditions, as set out above.

    3.11. Customer Care

    If you need help regarding your order or any other issue, you can reach out to the Amazon customer service department.

    3.12. Prohibited Electronic Equipment

    Customers are advised to avoid carrying Laptops, Handycams, iPads, Tablets and Digital Cameras to the cinema hall. Customers can, however, keep their mobile phones with them.

  4. General Guidelines

    4.1. Booking ID's generated only through Ticketing Platform shall be considered by us as a valid Booking ID.

    4.2. Ensure that the personal details entered including the card details are accurate. Booking ID's once generated cannot be cancelled/refunded/exchanged, save and except in case such cancellation is a feature made available by the relevant cinema through the Ticketing Platform.

    4.3. Anybody in possession of the Booking ID shall be entitled to get the same exchanged for a valid movie ticket without further security checks on the title of such holder.

    4.4. Ensure that the Booking ID's are not compromised or resold.

    4.5. Do not entertain any person who sells print outs or SMS of Booking ID's generated by the Ticketing Platform. If you come across any person undertaking such activity, immediately report the same to the local police station and to BookMyShow at 022 6144 5050, 022 3989 5050.

    4.6. We never sell a Ticket at a price higher than the price mentioned on the Ticketing Platform.

    4.7. We will never ask for your Personal Identification Number (PIN) details over the phone or through any means except through the transaction page on the Ticketing Platform when you book online.

    4.8. Do not encourage any persons posing as our authorised representative/agent trying to sell you special offer voucher/gift vouchers/physically printed booking id's/winpins/voucher ecodes etc. Report the same immediately to the Amazon Customer Support.

    4.9. Booking ID's generated by the Ticketing Platform entitles the holder to exchange it for a valid movie ticket. The same does not constitute a valid movie ticket in itself. We will never sell you Booking ID's as movie tickets.

    4.10. Booking ID's generated entitled the holder thereof to a valid ticket. It is your responsibility to ensure that the holder is the rightful holder of the same. Do not compromise or misuse the Booking ID's.

  5. Terms and Conditions for Club Cinépolis Loyalty Program

    5.1. The Club Cinepolis Loyalty Program is operated by Cinepolis India Private Limited ("Cinepolis"). To avail membership to the Cinepolis Loyalty Program the User has to transact on the Ticketing Platform and purchase movie tickets for any movie exhibited at Cinepolis cinema. The User shall then be auto enrolled for the Cinepolis Loyalty Program and shall receive 1 point for every Rs.15/- spent on booking tickets on the Ticketing Platform for Cinepolis Cinemas.CinepolisThe Club Cinepolis Loyalty Program is operated by Cinepolis India Private Limited ("Cinepolis"). To avail membership to the Cinepolis Loyalty Program the User has to transact on the Ticketing Platform and purchase movie tickets for any movie exhibited at Cinepolis cinema. The User shall then be auto enrolled for the Cinepolis Loyalty Program and shall receive 1 point for every Rs.15/- spent on booking tickets on the Ticketing Platform for Cinepolis Cinemas.

    5.2. The User's registered mobile number will be the unique identifier for the Club Cinepolis membership for the Cinepolis Loyalty Program. By accepting the terms of the Club Cinepolis Loyalty program you hereby give consent to Bigtree to share your registered mobile number with Cinepolis India and such sharing shall in no event be in violation of / breach of the applicable provisions under the Information Technology Act, 2000.

    5.3. The points received after 1st of April of any calendar year are valid until the 31st of March of the next calendar year. On the 1st of April, the unused points received since 1st of April of the previous year will be lost and the point balance will be set to zero.

    5.4. The points are redeemable at Cinépolis cinemas only.

    5.5. The points cannot be redeemed for cash.

    5.6. The points are non-transferable to another member.

    5.7. Cinepolis reserves the right, without limitation, to change, limit, modify or cancel rules relating to the Membership.

    5.8. If a Club Cinépolis member is found to be misusing the program and its benefits, his or her membership may be cancelled, or the person may be barred from using the program and Bigtree shall in no way be responsible for the same.

    5.9. Bigtree shall not be responsible for any loss, expiration, loss or theft of Club Cinépolis points.

    5.10. Membership benefits are offered at the discretion of Cinépolis including but not limited to issuance, redemption process, refund, cancellation and point accumulation and the same is between the User and Cinepolis and the User agrees that Bigtree shall in no way be responsible for any claims, disputes or loss arising out of such Membership.

    5.11. Bigtree shall in no event be held responsible for any claims/liabilities / costs/ disputes, loss arising out of availing the Club Cinepolis Membership benefits offered by Cinepolis through the said Membership and the User hereby expressly waives all his rights to make Bigtree responsible either directly or indirectly while using or transacting through Ticketing Platform.

    5.12. Bigtree is acts as an intermediary and there is no liability on Bigtree in relation to the services/offerings and/or membership terms and conditions offered by Cinepolis.

    5.13. In case User wishes to opt out of the Club Cinepolis Loyalty Program the same shall be as per the process sent out by Cinepolis to the concerned User.

  6. Notice & Take Down Policy

    AS AN INTERMEDIARY, BIGTREE AND AMAZON ARE NOT LIABLE FOR ANY THIRD-PARTY CONTENT UPLOADED, TRANSMITTED, DISPLAYED, PUBLISHED OR SHARED ON THE TICKETING PLATFORM. BY USING THE TICKETING PLATFORM, YOU AGREE TO THE CONDITIONS SET OUT IN THIS NOTICE AND TAKE DOWN POLICY

    6.1. Copyright Infringement Notification

    If the owner of a copyright-protected work or an agent authorized to act on the copyright owner's behalf (the "Owner") believes the work posted on Ticketing Platform (the "Site") is infringing the Owner's copyright under the relevant law, the Owner may submit a copyright infringement notification to BookMyShow.

    6.2. Copyright Infringement Notification Procedure

    Bigtree recommends Owners of copyright-protected content to report alleged copyright infringement by submitting a written complaint (the "Complaint") either through a web-form (recommended) or through email on . The Complaint should include the following:-

    1. Contact Information: The Owner will need to provide information that will allow Bigtree and the uploader(s) of the video(s) that the Owner's objects to, to contact the Owner regarding the Complaint, such as an email address, physical address or telephone number.
    2. Description of Work: The Owner's must provide in the complaint, a complete and accurate description of the copyrighted content that the Owner is seeking to protect. This MUST also include the specific URL of the video that the Owner believes to be infringing. This is necessary in order to aid Bigtree to locate the allegedly infringing video. General information about the video, such as a channel URL or username alone is not adequate. The URL should be in the following format: //www.amazon.in/_____________/
    3. Necessary Format: The Complaint should include the following statements - "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law." AND "The information in this notification is accurate, and I am the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
    4. Signature: The Complaint must include the physical or electronic signature/digital signature of the Owner. To satisfy this requirement, the Owner may type their full legal name (a first and last name, not a company name) as the signature at the bottom of the complaint.

    6.3. Take-Down of Copyright Infringing Work

    In case of a Complaint by the Owner that is submitted in accordance with the procedure in Clause 6.2, and found to be valid, Bigtree may refrain from facilitating access to the allegedly infringing work for a period of 21 (twenty one) days or until an order from a competent court is received, whichever is earlier. In case Bigtree receives no such order before the expiry of twenty-one days, Bigtree may reinstate access to the said work.

    6.4. Notification of Objectionable Content and Take Down by Bigtree

    Users may submit a Complaint against objectionable content by submitting a written complaint either through a web-form (recommended) or through email on . The Complaint should include the following:

    1. Contact Information: The Complainant will need to provide information that will allow Bigtree to contact the Complainant regarding the Complaint, such as an email address, physical address or telephone number.
    2. Description of Work: The Complainant must provide in the complaint, a description of the objectionable content that the Complainant is seeking to protest. This MUST also include the specific URL of the video that the Complainant believes to be objectionable. This is necessary in order to aid Bigtree to locate the allegedly objectionable video. General information about the video, such as a channel URL or username alone shall not be adequate. The URL should be in the following format: //www.amazon.in/_____________/.
    3. Necessary Format : The Complaint should include the following statements - "I have a good faith belief that the use of the material in the manner complained of violates any law, or the conditions in Clause 6.4 of Bigtree's Notice and Take Down Policy" AND "The information in this notification is accurate to my knowledge".

    If Bigtree determines, in its sole discretion and judgment, that the User Content violates any of the aforementioned conditions, it shall be entitled to immediately take down or otherwise block access to User Content

    6.5. Bigtree's and Amazon Immunity from Liability

    Bigtree and Amazon are intermediaries and shall not be liable for any act of copyright infringement or any other objectionable User Content, as provided under the Copyright Act, 1957, Information Technology Act, 2000 and Rules thereunder.

  7. Limited User

    7.1. The User agrees and undertakes not to sell, trade or resell or exploit for any commercial purposes, any portion of the Service. For the removal of doubt, it is clarified that the Ticketing Platform is not for commercial use but is specifically meant for personal use only.

    7.2. The User further agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Ticketing Platform. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the Ticketing Platform is not permitted.

  8. Disclaimer of Warranties / Limitation of liability

    8.1. Bigtree neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information contained on the Ticketing Platform. Bigtree makes no warranty, express or implied, concerning the website and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the use of the information contained in the Ticketing Platform.

    8.2. Since Bigtree acts only as a booking agent, it shall not have any liability whatsoever for any aspect of the arrangements between the cinema and the user as regards the standards of services provided by the cinemas. In no circumstances shall Bigtree be liable for the services provided by the cinemas.

    8.3. Although Bigtree makes reasonable commercial efforts to ensure that the description and content in the TOS and on each page of the Ticketing Platform (where any content is provided by Bigtree) is correct, it does not, however, take responsibility for changes that occurred due to human or data entry errors or for any loss or damages suffered by any user due to any information contained herein. Also, Bigtree is not the service provider and cannot therefore control or prevent changes in the published descriptions which are based upon information provided by other third parties.

    8.4. In no event shall Bigtree be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from: (a) the use or the inability to use the Services; (b) the cost of procurement of substitute goods and services or resulting from any goods, information or services purchased or obtained or messages received or transactions entered into through the Services; (c) unauthorized access to or alteration of the User's transmissions or data; (d) any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Ticketing Platform. Neither shall Bigtree be responsible for the delay or inability to use the Ticketing Platform, the provision of or failure to provide Services, or for any information, software, products, services and related graphics obtained through the Ticketing Platform, or otherwise arising out of the use of the Ticketing Platform, whether based on contract, tort, negligence, strict liability or otherwise. Further, Bigtree shall not be held responsible for non-availability of the Ticketing Platform during periodic maintenance operations or any unplanned suspension of access to the website that may occur due to technical reasons or for any reason beyond Bigtree's control. The User understands and agrees that any material and/or data downloaded or otherwise obtained through the Ticketing Platform is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data. These limitations, disclaimer of warranties and exclusions apply without regard to whether the damages arise from (a) breach of contract, (b) breach of warranty, (c) negligence, or (d) any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law. The maximum liability on part of Bigtree arising under any circumstances, in respect of any Services offered on the Ticketing Platform, shall be limited to the refund of total amount received from the customer for availing the Services less any cancellation, refund or others charges, as may be applicable. In no case shall the liability of Bigtree include any consequential loss, damage or additional expense whatsoever.

  9. User's Obligations

    9.1. In consideration of use of the Ticketing Platform, the User represents and confirms that the User is of legal age to enter into a binding contract and is not a person barred from using the Ticketing Platform and/or receiving the Services under the laws of India or other applicable law.

    9.2. To avail a Service the User has and must continue to maintain at his sole cost: (a) all the necessary equipments including a computer and modem etc. to access the Ticketing Platform/avail Services; (b) own access to the World Wide Web. The User shall be responsible for accessing the Services and that access may involve third party fees including, airtime charges or internet service provider's charges which are to be exclusively borne by the User.

    9.3. The User also understands that the services may include certain communications from Bigtree as service announcements and administrative messages. The user understands and agrees that the Services are provided on an "as-is" basis and that Bigtree does not assume any responsibility for deletions, mis-delivery or failure to store any user communications or personalized settings.

  10. Relationship

    None of the provisions of this Agreement, terms and conditions, notices or the right to use the Ticketing Platform by the User contained herein or any other section or pages of the Ticketing Platform shall be deemed to constitute a partnership between the User and Bigtree and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way.

  11. Headings

    The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this Agreement, the TOS or the right to use the Ticketing Platform by the User contained herein or any other section or pages of the Ticketing Platform or any Linked Sites in any manner whatsoever.

  12. Interpretation of number and Genders

    The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine and feminine. The words "include", "includes" and "including" shall be deemed to be followed by the phrase "without limitation". Unless the context otherwise requires, the terms "herein", "hereof", "hereto", "hereunder" and words of similar import refer to this Agreement as a whole.

  13. Indemnification

    The User agrees to indemnify, defend and hold harmless Bigtree from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Bigtree that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this Agreement and/or the TOS.

  14. Severability

    If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

  15. Notices

    15.1. All notices and communications (including those related to changes in the TOS, Services, etc.) shall be in writing, in English and shall deemed given if delivered sent via email (with acknowledgment of complete transmission) to .

    15.2. A notice shall be deemed to have been served 48 hours after it has been sent, unless, where it comes to the knowledge of the sending party, that the email has not been transmitted and received successfully.
